Do you think the makers of Evony care that Caesary is a total rip off. They’re both RTSs (Real-Time Strategy) games. Here’s Evony:

Evony - RTS that's a bit like Caesary

If you play one game, you can play the other without bothering with the tutorial, they’re so similar.

Who cares? All games are derivative (though, these two are more derivative than most) and, in a way, they have to be. Otherwise they wouldn’t be playable. It’s like Stop signs and Fire Exits – they’re mostly the same all round the world.

How do the games people survive this? Well, I suppose they manage in the same way as magicians and comedians. Another group of people who seem to manage without having absurdly antiquated copyright laws to protect them. Perhaps music isn’t like comedy or magic, though? Maybe pop songs are all unique in a way jokes and tricks aren’t?
